2.2 Delivery and Pickup Services
We offer delivery services within designated service areas, as well as in-store and curbside pickup options. Delivery availability, minimum order requirements, and delivery fees are subject to change and will be disclosed to you at the time of order placement.

Orders placed through such third-party platforms are subject to those platforms' own terms of service and privacy policies. Starbird Chicken is not responsible for the conduct, policies, or performance of any third-party delivery service.
3. User Accounts and Registration

5. Payment Terms
5.1 Pricing and Fees
All prices displayed on our website are in United States Dollars (USD) and are subject to applicable sales taxes, delivery fees, and service charges, which will be displayed to you prior to completing your purchase. Prices are subject to change without prior notice. We reserve the right to correct any pricing errors, even after an order has been submitted.
5.2 Payment Methods
We accept major credit cards (Visa, Mastercard, American Express, Discover), debit cards, and other payment methods as may be displayed at checkout. 5.3 Order Confirmation

In no event shall our total cumulative liability to you for any and all claims arising out of or relating to these Terms or our Services exceed the greater of: (a) the total amount you paid to Starbird Chicken in the three (3) months immediately preceding the event giving rise to the claim, or (b) One Hundred United States Dollars ($100.00).

12. Dispute Resolution
12.1 Informal Resolution
Before initiating any formal legal proceedings, you agree to first contact Starbird Chicken in writing at [email protected] and provide a detailed description of your dispute, including the specific relief you are seeking. We will make good faith efforts to resolve the dispute informally within thirty (30) days of receiving your written notice. If we are unable to resolve the dispute informally within that period, either party may proceed to formal dispute resolution as described below.
12.2 Binding Arbitration
Except for claims that may be brought in small claims court, any dispute, claim, or controversy arising out of or relating to these Terms or your use of our Services that cannot be resolved informally shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules and, if applicable, its Consumer Arbitration Rules. The arbitration shall be conducted in English. The arbitrator's decision shall be final and binding on both parties and may be entered as a judgment in any court of competent jurisdiction.
12.3 Class Action Waiver
YOU AND STARBIRD CHICKEN EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU EXPRESSLY WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
12.4 Exceptions
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information. Such an action shall not be deemed a waiver of the right to arbitrate under these Terms.
12.5 Time Limitation
Any claim or cause of action arising out of or relating to these Terms or the Services must be filed within one (1) year after such claim or cause of action arose, or it shall be forever barred, notwithstanding any statute of limitations to the contrary.
13. Food Safety and Allergen Disclaimer
Starbird Chicken takes food safety seriously and strives to maintain the highest standards of food preparation and handling in compliance with all applicable federal, state, and local food safety regulations, including guidelines established by the U.S. Food and Drug Administration (FDA) and applicable state health departments.
